1. DATA CONTROLLER

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016 (GDPR), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), we inform you:

TICKETES EUROPE SERVIC, S.L, hereinafter TICKETES, is the DATA CONTROLLER of the USER's personal data and informs you that this data will be processed in accordance with the provisions of the aforementioned regulations.

2. PERSONAL DATA WE PROCESS

TICKETES processes the following categories of personal data:

a) Registration and user account data: First and last name, email address, password (in encrypted format), phone number.

b) Purchase data: Name of the holder, billing address, transaction data (amount, date, reference), tickets purchased.

c) Payment data: TICKETES does not store credit/debit card data. Payment processing is delegated to certified payment service providers.

d) Browsing data: IP address, browser type, pages visited, session duration, cookie data (in accordance with the Cookie Policy)

e) Communication data: Inquiries, complaints, or requests sent through the customer service channels indicated on this website.

3. PURPOSES AND LEGAL BASIS FOR PROCESSING

At TICKETES, we will process your personal data collected through the Website: ticketes.com, for the following purposes:

  1. To comply with the company's commercial, labor, corporate, and accounting obligations.
  2. Sending commercial information and newsletters about new services offered on the web and in the sector.
  3. The transmission of data to third parties with whom contracts have been established for this purpose, for commercial, contractual, administrative, marketing, and/or operational purposes.
  4. To provide the services contracted by the user.
  5. To send promotional information electronically.
  6. To provide the information requested by the user through the contact form.

The processing of your data is carried out based on the following legal grounds that legitimize it:

  1. The request for information and/or the contracting of services from TICKETES EUROPE SERVIC, S.L, whose terms and conditions will be made available to you in any case, prior to any potential contracting.
  2. The free, specific, informed, and unequivocal consent, as we inform you by providing this privacy policy, which after reading it, if you agree, you can accept through a declaration or a clear affirmative action, such as checking a box provided for that purpose.

If you do not provide us with your data or do so incorrectly or incompletely, we will not be able to attend to your request, making it entirely impossible to provide you with the requested information or to carry out the contracting of the services.

4. COMMERCIAL COMMUNICATIONS

In accordance with the LSSI, TICKETES will not send advertising or promotional communications by email or any other equivalent electronic communication method that have not been previously requested or expressly authorized by the recipients.

In the case of users with whom there is a prior contractual relationship, TICKETES EUROPE SERVIC, S.L is authorized to send commercial communications regarding products or services of TICKETES EUROPE SERVIC, S.L that are similar to those initially contracted with the customer.

In any case, the user may request not to receive any further commercial information through the customer service channels indicated on this website.

5. RECIPIENTS OF THE DATA

Personal data may be communicated to:

a) Event promoters: TICKETES will transmit to the event promoter the strictly necessary data for managing the ticket (buyer's name, purchase reference). The promoter acts as an independent data controller for their own purposes.

b) Data processors: Providers of technological, hosting, payment, and email marketing services that act on behalf of TICKETES, with whom the data processing agreements required by Article 28 of the GDPR have been signed.

c) Public administrations and authorities: When required by applicable regulations.

TICKETES does not sell or transfer personal data to third parties for their own advertising or commercial purposes.

6. INTERNATIONAL DATA TRANSFERS

In the event that any TICKETES provider is located outside the European Economic Area, such transfers will be carried out with the appropriate safeguards provided for in Chapter V of the GDPR (adequacy decisions, standard contractual clauses, etc.).

7. DATA RETENTION PERIOD

Data will be retained for as long as necessary to fulfill the purpose for which it was collected and, in any case, for the applicable legal limitation periods:

  • Transaction and billing data: 6 years (art. 30 Commercial Code).
  • Tax data: 4 years (General Tax Law).
  • Commercial communication data: Until the user revokes their consent.
  • Browsing data and cookies: In accordance with the Cookie Policy.

After these periods, the data will be deleted or anonymized irreversibly.

8. RIGHTS OF THE DATA SUBJECTS

The user has the right to:

  • Access: Know what personal data TICKETES processes.
  • Rectification: Request the correction of inaccurate or incomplete data.
  • Erasure ("right to be forgotten"): Request the deletion of their data when, among other cases, it is no longer necessary for the purpose for which it was collected.
  • Restriction of processing: Request the restriction of the processing of their data in certain cases.
  • Portability: Receive their data in a structured, commonly used, and machine-readable format.
  • Objection: Oppose the processing of your data, particularly for commercial communications.
  • Not to be subject to automated decisions: Including profiling with significant legal effects.

How to exercise your rights?

TICKETES will respond within a maximum period of one month from the receipt of the request, extendable by another two months in cases of special complexity.

Complaint to the AEPD: Without prejudice to the above rights, the user has the right to file a complaint with the Spanish Agency for Data Protection (AEPD) if they believe that the processing of their data is not in accordance with current regulations (www.aepd.es).

9. SECURITY MEASURES

In accordance with the provisions of current regulations on personal data protection, TICKETES is complying with all provisions of the RGPD and LOPDGDD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the RGPD, by which they are processed lawfully, fairly, and transparently in relation to the data subject and are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

TICKETES guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has communicated the appropriate information to them so that they can exercise these rights.

10. MODIFICATIONS

TICKETES reserves the right to modify this Privacy Policy to adapt it to legislative or jurisprudential developments.
